Whether the debtor (person who owes the money) is a person or a business, often the collection can be accomplished by something as simple as a phone call or sending a letter. Persons attempting to collect on a debt must err on the side of caution, as laws such as the Federal Fair Debt Collection Practices Act and the Michigan Consumer Protection Act provide severe penalties designed to protect a debtor from abusive collection practices.
A person who is not versed in the laws of collection risks facing stiff monetary penalties for violations aforementioned acts. Many tools are available such as construction and mechanics liens, suits based in contract (breach of contract) and writs of restitution and garnishments.
